Driveway: A dumpster placed entirely on private property - a driveway, parking lot, or private yard - does not need the Right-of-Way Work Permit. The city's own Type A trigger list draws the line explicitly: 'Placing a Dumpster (not on private property).' Once any part of the container, or the truck's staging, sits in the street, alley, sidewalk, or parkway, the $100 Type A permit applies. Two related placement rules: Bryan Code § 102-23(d) states that items set out for city collection 'may not be set for collection on a public street, sidewalk, or right-of-way,' and § 102-23(b) requires brush/bulky piles to sit at least five feet from fixed objects, buildings, structures, and utility meters and not under tree branches or overhead wires - good practice for siting a roll-off on a driveway too. Bryan publishes no maximum number of days a dumpster may remain on private property; no such limit was found in Chapters 38, 102, or 106.

Street / right-of-way: YES. Placing a roll-off dumpster in the public right-of-way (street, alley, parkway, sidewalk) requires a City of Bryan Right-of-Way Work Permit, Type A (Special). Bryan Code § 106-170(a): 'It is unlawful for any person to do any work within a public right-of-way without first obtaining a right-of-way work permit from the city.' The city's own ROW permit page lists the Type A triggers verbatim as: 'Drop off or delivery of materials (more than one hour) / Placing cranes or High lifts in right-of-way / Placing dumpsters or POD's, etc. in right-of-way / Remodeling/Painting/Pressure Cleaning / Placing a Dumpster (not on private property) / Storing building materials / Tree Trimming / Other.' Apply through the online permitting portal (citizenserve.com/cityofbryantx) or by email to [email protected]. Codified authority is Chapter 106, Bryan City Code. NOTE: the city does not publish a turnaround time, insurance limit, or bond amount online - confirm those with Engineering Services before promising a same-day street placement. Work in the ROW outside 7 a.m.-7 p.m. Monday-Saturday requires a separate justification and a draft resident door-hanger notice submitted through the portal.

Fee: $100.00 - Type A, Special, codified at Bryan Code § 106-172(a)(1): '$100.00 - Type A, special (including but not limited to placing cranes, dumpsters, building materials, tree trimming)' (Ord. No. 2229, § 2(Exh. A), 8-28-2017). Same $100 amount is published on the city's Rights-of-Way page. For reference, other ROW permit types: Type B utility construction $500, Type C utility maintenance $500, Type D residential (sidewalk/driveway repair) $100, Type E other, incl. street/sidewalk closures $200; special use license $250. SEPARATE FEE - the Chapter 102 waste hauler permit: the ordinance sets no dollar amount (§ 102-3 leaves solid waste rates and fees to city council resolution), and no hauler permit fee is published on bryantx.gov. Do not state a hauler permit fee without confirming it with Public Works at 979-209-5900.

Local rules worth knowing

• HAULER LICENSING - a city waste hauler permit is mandatory. Bryan Code § 102-82: any person other than a self-transporter who collects 'rubbish, construction, demolition or recyclable materials within the city for disposal must hold a valid waste hauler permit.' § 102-83 goes further: no permit issues unless the hauler holds 'a current, executed agreement with the city, approved by the city council,' and the section states plainly that 'The city may at its discretion deny any and all waste hauler permits.' This is a real barrier to entry, not a rubber stamp - a new operator must get on a council agenda. Permit term runs to September 30 and auto-renews for two additional one-year terms, October 1 through September 30 (§ 102-84). Specialized waste haulers that only remove hazardous waste are exempt from the permit (§ 102-2(c)).
• THE CARVE-OUT THAT MAKES THIS MARKET LEGAL - Bryan Code § 102-81 ('Private collection prohibited'): 'The private collection of municipal solid waste within the limits of the city is hereby prohibited. Properties requiring containers larger than the city can provide (i.e. roll-offs or compactors) and/or require services the city does not provide (i.e. construction & demolition waste, household and commercial recycling) may contract with a private waste hauler.' Roll-offs and C&D debris are exactly the services the city does not provide - that is the whole legal basis for third-party dumpster rental in Bryan. Routine household and small-commercial garbage collection, by contrast, belongs to the city.
• PERMITTED CONTAINER REQUIRED ON JOBSITES - Bryan Code § 102-4(b): 'All construction waste generated at a construction site prior to and during demolition and construction shall be contained. It shall be unlawful for a construction site contractor or construction site owner to use or permit the use of a private waste container that is not permitted by the city for the purposes of containing construction waste at a construction site.' A contractor who rents from an unpermitted hauler is the one breaking the law. § 102-4(a) allows the alternative of self-transporting with the generator's own employees, but expressly forbids using an independent contractor for that. § 102-4(d): general land clearing or cleanup of vacant lots will not be collected by the city - private hauler or self-transport only.
• MANDATORY DISPOSAL SITE (FLOW CONTROL) - Bryan Code § 102-85: 'Private waste haulers shall use the Brazos Valley Solid Waste Management Agency (BVSWMA) landfill for disposal of all waste collected by the waste hauler within the corporate limits of the city.' Recyclables collected under permit must go to a city-approved recycling facility and 'at no time shall any of the recyclable material collected be placed in a landfill.' A Bryan-permitted hauler cannot shop for a cheaper out-of-county tipping floor for city-generated waste.
• BULK PICKUP LIMIT - THE DUMPSTER TRIGGER. Bryan gives each residence once-weekly brush and bulky collection capped at 'a maximum of 22 cubic yards or one truck load of materials for each residence... each week' (bryantx.gov); Code § 102-23(h) defines one load as 'the volume of the collection vehicle.' Brush must be cut into sections no longer than eight feet (§ 102-23(f)). Set out by 7 a.m. on collection day (6 a.m. June-August), no earlier than 48 hours before, at least five feet from fixed objects, not under branches or overhead wires, and brush separated from bulky in two piles. Critically, the city will NOT take: 'unused construction and demolition materials from projects such as landscaping, remodeling, and sidewalk and driveway improvements,' concrete, brick or rock, household garbage, chemicals, or food waste. The code's definition of bulky waste (§ 102-1) likewise excludes construction waste, tires, and hazardous/medical waste. Commercial properties get no regular brush and bulky service at all (§ 102-44) - on-demand only, at the city manager's discretion and for a fee. So: a homeowner's furniture and yard debris are covered up to 22 cubic yards; a remodel, a roof tear-off, a driveway demo, or any commercial cleanout is not - that is when a roll-off becomes the only lawful route.
• PROHIBITED IN THE CITY CART - Bryan Code § 102-61(3) makes it unlawful to place construction waste, bulky waste, brush waste, stable matter (rock, brick, glass, dirt), appliances, tires, metal, liquids such as paint or motor oil, hot ashes, corrosive solvents, pool chemicals, car batteries, dead animals, hazardous waste, or medical waste in a city MSW container. The generator has to remove such items before collection or pay the city's actual cost to do so. § 102-61(9) prohibits disposing of special waste in any sanitary landfill.
• COMMERCIAL SERVICE CEILING - Bryan Code § 102-41: all commercial properties must take city collection, with a minimum of the city-issued container and 'a maximum volume of eight yards.' Once a business needs more than the city can provide, § 102-41(a) and § 102-81 require it to use a permitted private hauler. Eight cubic yards is the practical line above which a private roll-off is the only option.
• NO C&D DIVERSION MANDATE. No construction & demolition recycling or diversion ordinance was found anywhere in the Bryan Code - Chapter 102 (Solid Waste), Chapter 38 (Environment), Chapter 78 (Natural Resources), and Chapter 14 (Buildings) contain no diversion percentage, no waste management plan requirement, and no deposit-refund program. Texas has no statewide C&D diversion mandate either. The only diversion-flavored rule is § 102-85's ban on landfilling recyclables that a permitted hauler collected as recyclables. Do not claim a diversion requirement exists in Bryan.
• CITY RESERVES THE RIGHT TO GO EXCLUSIVE - Bryan Code § 102-87: the city reserves the right to become the sole collection/disposal provider or to 'enter into one or more franchise agreements' under section 16(n) of the Bryan City Charter, and city council may revoke any and all waste hauler permits without cause effective September 30 of any year on 60 days' written notice. As of this research the market is open to permitted haulers, but the status is revocable - describe Bryan as permit-based, never as a permanently open market.
• CURRENT CITY-PERMITTED ROLL-OFF PROVIDERS (published list, bryantx.gov): Pronto Services 979-665-4465; BVR Waste and Recycling 979-260-0006; Texas Commercial Waste 979-775-7171; Drop and Go Dumpsters 979-807-4522; Maroon Dumpsters 979-595-6446. Permitted curbside recyclers: BVR Waste and Recycling 979-260-0006; Brazos Valley Trash Valet and Recycling 979-777-8968; Texas Commercial Waste 979-775-7171. The city states plainly that 'roll-off services are not provided by the City of Bryan, however, the city permits certain roll-off providers to offer these services' - appearing on that list is the credibility signal in this market.
• TARP/SECURED LOAD RULE AT THE LANDFILL - every vehicle entering Twin Oaks must be covered and secured (tarp, cargo net, wire screen, or fully enclosed compartment) or face a $30.00 unsecured load fee. Bryan Code § 106-24 separately addresses vehicles dropping loads on city streets. Scavenging is prohibited both at the landfill and from city containers (§ 102-61(8)).
• REGIONAL CONTEXT - neighboring College Station runs the same model: commercial and roll-off service through city-licensed private haulers under College Station Code Ch. 40, Art. IV, with 18+ licensed companies. Both cities co-own BVSWMA. A hauler working Bryan-College Station needs authorization from each city separately.
